These Terms and Conditions of Sale and Use (hereinafter the "Terms") govern your access to and use of this website, as well as any purchase of products made through it.

By accessing this website, using any of its services or placing an order, you acknowledge that you have read, understood and accepted these Terms without reservation.

1. WEBSITE ACCESS AND APPLICATION OF THESE TERMS
This website is intended exclusively for online sales to consumers acting for personal purposes. Customers wishing to purchase products for commercial purposes are invited to contact Luxmarter directly.
1.1 Access and Acceptance
Access to and use of LUXMARTER.COM constitute unconditional acceptance of these Terms, which apply to every order placed on the website.
The Terms applicable to an order are those in force on the date the order is placed.
1.2 Customer Account
To place certain orders, you may be required to create a customer account.
You are responsible for ensuring that the information provided is accurate, complete and kept up to date.
You are also responsible for maintaining the confidentiality of your login credentials and must not allow any third party to use your account.
2. PRODUCTS
Luxmarter is an online concept store offering a carefully curated selection of jewellery, accessories for women and men, clothing and accessories for children, home décor items, face and body care products, as well as selected food products (including confectionery, herbal teas and spreads).
2.1 Product Description
Luxmarter endeavours to present its products as accurately as possible.
However, due to the handcrafted nature of many of our products, slight variations in colour, size, texture, shape or finish may occur and shall not be regarded as a lack of conformity.
By placing an order, the customer acknowledges having read the information relating to the selected product(s), including their essential characteristics, prior to confirming the order.
2.2 Product Availability
Products are offered for sale subject to availability.
Luxmarter reserves the right to modify, discontinue or withdraw any product from sale at any time.
If a product becomes unavailable after an order has been placed, the order relating to that product will be cancelled and any corresponding payment will be refunded.
2.3 Luxmarter's Commitments
At Luxmarter, we are committed to offering a carefully curated selection of creations chosen for their quality, originality and craftsmanship.
Whenever possible, we work with designers and manufacturers established in Europe whose creations are handcrafted or produced in limited quantities.
Where this information is available, the country of manufacture or origin of each creation is indicated on the relevant product page.
Product descriptions are prepared using the information provided by the designers and manufacturers. While Luxmarter takes the greatest care to ensure their accuracy, we cannot guarantee the origin of every individual component or raw material used in the manufacture of a product unless expressly stated otherwise.
Because every creation deserves special attention, Luxmarter is equally committed to providing a premium customer experience, carefully prepared packaging and responsive customer service throughout every order.
3. ORDERS
3.1 Ordering Process
Placing an order constitutes an offer by the customer to purchase the selected product(s).
An order becomes binding only once payment has been successfully completed and the order has been accepted by Luxmarter.
An order confirmation will then be sent to the customer by e-mail.
4. PRICES, PAYMENT AND INVOICING
4.1 Prices
All prices displayed on LUXMARTER.COM are expressed in euros (€) and include the applicable Value Added Tax (VAT), unless otherwise stated.
Shipping costs are not necessarily included in the product price and will be calculated and displayed before the customer confirms the order.

4.2 Payment
Payment may be made using the payment methods offered on the website, including credit and debit cards and any other payment solutions available at the time of purchase.
By placing an order, you confirm that you are authorised to use the selected payment method and that all payment information provided is accurate and complete.
5. DELIVERY
Orders are prepared with the utmost care and shipped to the delivery address provided by the customer when placing the order.
Products purchased on LUXMARTER.COM are dispatched from Luxembourg to the countries available at the time of ordering.
Luxmarter works with reliable delivery partners in order to ensure secure and appropriate shipping.

5.1 Delivery Times
The delivery times indicated during the ordering process are estimates only.
They may vary depending on the destination and on circumstances beyond Luxmarter's reasonable control, including strikes, epidemics, natural disasters, force majeure events or disruptions affecting the supply chain of our artisans or suppliers.
Delivery delays resulting from circumstances beyond Luxmarter's control shall not entitle the customer to compensation, cancellation or damages, except where otherwise required by applicable law.
Should a delay occur, Luxmarter will inform the customer as soon as reasonably possible and, where possible, provide an updated estimated delivery date.
In any event, Luxmarter undertakes to deliver the goods within the agreed delivery period or, where no delivery period has been agreed, no later than thirty (30) days after the conclusion of the contract, unless otherwise expressly agreed between the parties.
Nothing in this Article shall affect the mandatory rights granted to consumers under Luxembourg consumer protection law.
5.2 Delivery Address
The customer is solely responsible for ensuring that the delivery information provided is complete and accurate.
If an incorrect address is provided, the delivery is refused, or the parcel is not collected:
- any re-shipping costs shall be borne by the customer;
- no refund shall be granted where the parcel has been delivered in accordance with the information supplied by the customer, without prejudice to the customer's statutory rights.
5.3 Shipping Costs
Shipping costs are displayed before the order is confirmed and depend on the delivery destination, parcel weight and total order value, as specified in the "Delivery" section of the website.
Certain orders may qualify for free shipping in accordance with the conditions applicable on the date the order is placed.
5.4 Taxes and Customs Duties
Prices displayed on the website are expressed in euros (€) and include VAT where applicable.
For deliveries within the European Union, customers are generally not required to pay additional customs duties or import taxes.
For deliveries outside the European Union, or where import formalities apply under local legislation, any customs duties, local taxes, clearance fees or other charges imposed by the competent authorities shall be borne exclusively by the customer, unless otherwise expressly stated by Luxmarter.
Customers are encouraged to contact the customs or tax authorities of their destination country before placing an order in order to determine any applicable import charges.
5.5 Transfer of Risk
The risk of loss or damage to the goods passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.
Until that moment, all transport-related risks remain the responsibility of Luxmarter.
Where loss, damage or incomplete delivery occurs before the customer takes possession of the goods and such loss is attributable to the carrier, Luxmarter will take the appropriate measures in accordance with applicable law.
Where the customer independently appoints a carrier other than the one proposed by Luxmarter, the risk transfers to the customer upon delivery of the goods to that carrier, in accordance with Luxembourg law.
6. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
6.1 General Principle
In accordance with applicable Luxembourg and European legislation governing distance selling, customers have the right to withdraw from their purchase within fourteen (14) days from the date of receipt of the goods, except in the cases referred to in Article 6.2.

Once the request has been received, Luxmarter will issue a return authorisation number to facilitate the processing of the return.
Any withdrawal request shall be subject to the conditions set out below.
6.2 Products Excluded from the Right of Withdrawal
In accordance with applicable legislation, the right of withdrawal does not apply to:
- personalised, customised or made-to-order products;
- sealed products which have been unsealed by the customer after delivery and which cannot be returned for reasons of health protection or hygiene, including earrings, body piercings, beauty, skincare and personal care products sold on LUXMARTER.COM;
- food products.
These products may not be returned, exchanged or refunded unless they are defective or do not conform to the contract.
6.3 Return Conditions
Customers must return the goods within fourteen (14) days from the date on which they communicated their decision to withdraw.
Returned products must be in a condition suitable for resale and, where applicable, accompanied by any accessories and the original packaging, provided that such packaging could reasonably have been retained after opening the parcel.
Customers are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods, in accordance with applicable legislation.
Customers are encouraged to handle jewellery with the same level of care that would reasonably be expected when examining similar items in a physical retail store, in order to preserve their condition and value.
6.3.1 Refund Following Withdrawal
Luxmarter will reimburse all payments received for the returned products, including, where applicable, the cost of the standard delivery option offered at the time of purchase.
The direct cost of returning the goods remains the responsibility of the customer, unless otherwise required by law.
Luxmarter may withhold reimbursement until the returned goods have been received or until the customer has provided evidence of having sent back the goods, whichever occurs first.
Refunds will be made using the same payment method used for the original transaction, unless expressly agreed otherwise.
6.4 Damaged or Non-Conforming Products
All products are carefully inspected before shipment.
If a parcel is received in a damaged condition, customers are encouraged to accept the delivery subject to reservation and to contact Luxmarter within seventy-two (72) hours, providing supporting photographs where possible, in order to facilitate the handling of the claim with the carrier.
Any claim concerning a damaged or non-conforming product should be reported:
- to the carrier; and
- to Luxmarter by e-mail at contact@luxmarter.com, together with supporting photographs.
6.4.1 Refund or Replacement of Damaged or Non-Conforming Products
Where a product is delivered in a damaged or non-conforming condition, Luxmarter will, at the customer's choice and in accordance with applicable law, arrange either a replacement or a full refund, including the original delivery costs.
In such cases, the cost of returning the goods shall be borne by Luxmarter.
Following receipt of the returned goods and confirmation of the lack of conformity, Luxmarter will process the refund without undue delay, using the original payment method.
A refund confirmation will be sent to the customer by e-mail.
In all cases, reimbursement shall be made no later than fourteen (14) days, in accordance with applicable legal requirements.
7. LEGAL GUARANTEES
Luxmarter is required to deliver products that conform to the sales contract and is liable for any lack of conformity existing at the time the goods are delivered, in accordance with the applicable provisions of Luxembourg law.
Where a lack of conformity becomes apparent within the period provided by applicable legislation, the customer benefits from the Legal Guarantee of Conformity. Subject to the conditions laid down by law, the customer may request the repair or replacement of the product. Where such remedies are impossible or disproportionate, the customer may, where legally applicable, request an appropriate price reduction or terminate the contract.
In addition to the Legal Guarantee of Conformity, customers also benefit from the Legal Warranty against Hidden Defects, as provided for under Luxembourg law. This warranty applies where a hidden defect renders the product unfit for its intended purpose or significantly reduces its usefulness to such an extent that the customer would not have purchased it, or would have paid a lower price had they been aware of the defect.
These statutory guarantees apply independently of any commercial warranty that may be offered by Luxmarter or by the manufacturer.
Where Luxmarter honours a legal guarantee in favour of a customer, it reserves the right to exercise any legal recourse available against the manufacturer, importer or supplier concerned, in accordance with applicable law.
8. LIABILITY
Luxmarter exercises the greatest care in the selection, presentation and marketing of the products offered on its website, as well as in ensuring the accuracy of the information published online. Despite these efforts, certain information may occasionally contain inadvertent errors, omissions or inaccuracies. Luxmarter reserves the right to modify, supplement or update such information at any time.
The products offered on LUXMARTER.COM are intended for normal personal use and, where applicable, must be used in accordance with the instructions for use, care and storage provided with the product. They are not intended to replace medical, dermatological or professional advice.
Jewellery is by nature a delicate product requiring appropriate care. Its durability depends in particular on the frequency of use, the conditions under which it is worn and compliance with the care instructions provided.
Customers are responsible for checking the characteristics, composition and any precautions relating to the products before use. Luxmarter shall not be liable for damage resulting from improper use, failure to follow the care instructions, modification of the product, normal wear and tear, or individual allergic reactions or intolerances.
As many of the products sold by Luxmarter are handcrafted, slight variations in colour, texture, shape, dimensions or finish may occur from one item to another. Likewise, product photographs, descriptions and illustrations are provided with the greatest care but may differ slightly from the products delivered due to screen settings, lighting conditions or the specific nature of the materials used. Such differences shall not constitute a lack of conformity where they do not affect the essential characteristics of the product.
Normal wear and tear, oxidation, discolouration or deterioration resulting from the passage of time, exposure to water, cosmetics, perfumes, chemicals or the wearer's individual skin characteristics shall not give rise to any liability on the part of Luxmarter.
Luxmarter shall not be liable for any failure or delay in performing its obligations where such failure or delay results from force majeure or any other circumstance beyond its reasonable control, in accordance with applicable law.
LUXMARTER.COM may occasionally be temporarily unavailable due to maintenance, technical reasons or circumstances beyond Luxmarter's control.
Nothing in this Article limits or excludes the mandatory statutory rights granted to consumers under Luxembourg law.
9. INTELLECTUAL PROPERTY
All elements of this website, including but not limited to texts, photographs, illustrations, logos, graphics, videos, visual content, databases and any other material, are protected by applicable intellectual property laws.
Unless prior written authorisation has been obtained from Luxmarter, any reproduction, representation, adaptation, modification, distribution or exploitation, whether in whole or in part, of the website or any of its contents is strictly prohibited.
All trademarks, trade names and logos displayed on this website remain the exclusive property of their respective owners.

15. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg.
In the event of a complaint or dispute, customers are encouraged to contact Luxmarter first, using the contact details provided in Article 16, in order to seek an amicable solution.
Customers may also refer the matter to the consumer mediation body competent in their country of residence where such procedure is available under applicable law.
Any dispute arising out of or in connection with these Terms shall fall within the jurisdiction of the competent courts of the Grand Duchy of Luxembourg, unless mandatory legal provisions provide otherwise.
