Welcome to LUXMARTER.COM. The terms we, us and our refer to Luxmarter, owner and operator of this website. These Terms and Conditions of Use and Sale (hereinafter referred to as the “Terms”) govern your access to and use of this website, as well as any purchase of products. By using this website or placing an order, you fully accept these Terms.


1. ACCESS TO THE WEBSITE AND ACCEPTANCE OF THE TERMS

1.1 Access & acceptance

Access to and use of LUXMARTER.COM imply full and unconditional acceptance of these Terms. You declare that you have the legal capacity to enter into a contract.

1.2 Customer account

To place certain orders, you may be required to create a customer account. You are responsible for the accuracy of the information provided and for maintaining the confidentiality of your login details.


2. PRODUCTS

Luxmarter is an online concept store offering a curated selection of jewellery, accessories for women and men, clothing and accessories for children, home décor items, facial and body care products, as well as food products (including sweets, herbal teas and spreads).

2.1 Product description

Luxmarter strives to present products as accurately as possible. However, due to the artisan nature of certain items, slight variations in colour, size, texture or shape may occur and shall not be considered defects.

2.2 Availability

Products are offered subject to availability. Luxmarter reserves the right to modify or discontinue any product at any time.


3. ORDERS

3.1 Order process

Placing an order constitutes an offer to purchase. The order is deemed accepted once payment has been received and processed.

3.2 Cancellation & modifications

Any request for cancellation or modification must be made before order confirmation. Luxmarter cannot guarantee changes once order processing has begun.


4. PRICES, PAYMENT AND INVOICING

4.1 Prices

Prices are displayed in euros (€) and include applicable VAT. Shipping costs are not necessarily included and are added at checkout.

4.2 Payment

Payment is made using the methods offered on the website (credit/debit cards or other alternatives). You warrant that the payment information provided is accurate and that you are authorised to use the selected payment method.


5. DELIVERY

Products ordered on LUXMARTER.COM are shipped from Luxembourg to the destinations available at checkout.

Luxmarter works with reliable carriers to ensure careful and appropriate delivery. Detailed delivery terms (delivery times, carriers, shipping fees and delivery areas) are available in the “Delivery” section of the website.

Delivery times

Delivery times indicated at checkout are provided for information purposes only and may vary depending on destination, exceptional circumstances or force majeure.
Delivery delays shall not give rise to any penalty, compensation or order cancellation, unless otherwise required by law.

Delivery address

The customer is responsible for the accuracy of the delivery information provided.
In the event of an incorrect address, refusal of delivery or failure to collect the parcel:

  • reshipping costs shall be borne by the customer;
  • no refund will be issued if tracking confirms delivery.

Shipping fees

Shipping fees are specified before payment confirmation and depend on the delivery zone, parcel weight and order amount.
Certain orders may qualify for free shipping, subject to the conditions indicated on the website.

Taxes and customs

  • Luxembourg and European Union: no additional customs duties or taxes apply.
  • Non-EU countries: local taxes or customs duties may apply and remain the responsibility of the customer.

Damaged products or order errors

All products are carefully inspected before shipment.
If a damaged parcel is received, the customer is requested to accept delivery with reservation and contact Luxmarter within 48 hours, providing photos as evidence.

If a product is delivered damaged or non-compliant, Luxmarter will cover the exchange or issue a full refund, including shipping costs.


6. RIGHT OF WITHDRAWAL, RETURNS & REFUNDS

6.1 General principle

In accordance with applicable distance-selling legislation, the customer has a period of fourteen (14) days from receipt of the order to exercise the right of withdrawal, except for the exclusions listed in Article 6.2.

To exercise this right, the customer must contact Luxmarter at contact@luxmarter.com within this period to obtain a return authorisation number.
No return will be accepted without prior authorisation.


6.2 Products excluded from the right of withdrawal

In accordance with legal provisions, the right of withdrawal does not apply in particular to:

  • health and hygiene products (Health & Beauty collection: facial care, body care, cosmetics, soaps, oils, etc.);
  • food products;
  • sealed goods that have been unsealed after delivery for health or hygiene reasons;
  • customised, personalised or made-to-order items.

These products cannot be returned, exchanged or refunded, except in the case of defective or non-compliant items.


6.3 Return conditions

Once the return has been authorised by Luxmarter:

  • Defective or non-compliant product:
    Luxmarter will issue a full refund and provide a return shipping label.
  • All other cases:
    The refund will be issued minus shipping costs.
    If free shipping was granted, the original shipping costs incurred by Luxmarter will be deducted.

Returned products must:

  • be in their original condition and packaging;
  • include a copy of the invoice;
  • be sent within 14 days from the return authorisation date.

Return shipping costs are borne by the customer, except in the case of damaged or defective products.

Luxmarter reserves the right to refuse any return that does not comply with these conditions.


6.4 Products damaged during delivery

The customer must carefully inspect the parcel upon receipt.
Any visible damage must be noted on the delivery receipt as “damaged parcel” before signing.

Any claim regarding a damaged product must be reported:

  • to the carrier; and
  • to Luxmarter at contact@luxmarter.com,
    within a maximum of 48 hours after receipt, with photos provided.

After this period, the claim may be refused.


6.5 Refunds

After receipt and inspection of returned items, Luxmarter will process the refund as soon as possible using the original payment method.
A refund confirmation will be sent by email.


7. INTELLECTUAL PROPERTY

All content published on this website (texts, images, logos, design) is the exclusive property of Luxmarter and/or its partners. Any unauthorised reproduction is prohibited.


8. PROHIBITED USES

You agree not to use the website for unlawful or harmful purposes (including fraud attempts, hacking, spam, etc.). Luxmarter may suspend or terminate any account in the event of a breach.


9. LIMITATION OF LIABILITY

9.1 No absolute guarantee

Products and services are provided “as is”. Luxmarter does not guarantee the absence of errors or interruptions.

9.2 Limited liability

Luxmarter shall not be held liable for indirect damages resulting from the use of the website or the purchase of products.


10. MODIFICATION OF THE TERMS

Luxmarter reserves the right to modify these Terms at any time. Updated versions will be published online with a revised date.


11. APPLICABLE LAW & JURISDICTION

These Terms are governed by Luxembourg law. Any dispute shall be submitted to the competent courts of Luxembourg, unless mandatory consumer protection rules provide otherwise.
